Welcome to Harmonicon! These Terms of Service ("Terms") govern your use of the Harmonicon web application, including www.harmonicon.app, play.harmonicon.app, and harmonicon.app (collectively, the "Service"). The Service is owned and operated by Euclidean Arts & Tech LLC, a Maryland limited liability company ("Company", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use Harmonicon.

1. Eligibility and Account Registration

• Age Requirement: You must be at least 18 years old to create an account and use the Service. If you are under 18, a parent or legal guardian must create the account on your behalf and agree to these Terms.
• Account Creation: To access the core features of Harmonicon (including interactive levels and game content at play.harmonicon.app), you must register for an account. You agree to provide accurate, complete, and current information during registration and to update such information to keep it accurate.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Use of the Service and Prohibited Conduct

Harmonicon is designed to teach music theory interactively by connecting to your MIDI piano via the browser’s MIDI API. To ensure a fair and safe environment for all users, you agree not to engage in the following prohibited conduct:

• Cheating or Falsifying Data: Using third-party software, scripts, or cheats to send artificial or automated MIDI data to the Service to bypass levels or gain an unfair advantage.
• Harassment and Abuse: Engaging in verbal harassment, bullying, or abusive behavior toward other users in battle chats.
• Hate Speech: Using derogatory words, slurs, or hate speech of any kind.

Account Termination: We reserve the right to suspend or permanently terminate your account immediately, without notice or liability, if you violate any of these rules, particularly regarding cheating or abusive behavior.

3. User-Generated Content

• Messaging: Harmonicon allows users to send text messages to one another (e.g., during battle chats).
• Ownership and License: You retain full ownership of any messages you send. However, by sending messages through the Service, you grant Euclidean Arts & Tech LLC a worldwide, royalty-free, non-exclusive license to display, transmit, and use those messages as necessary to operate and provide the Service.
• Content Restrictions: You may not post or send any content that is illegal, harassing, derogatory, or violates the rights of others. We reserve the right to review and remove any messages that violate these Terms.

4. Payments, Subscriptions, and Refunds

Harmonicon offers a free tier, a monthly subscription tier, and one-time purchases.

• Monthly Subscriptions: Subscriptions are billed automatically on the same day each month based on your initial subscription date. You may cancel your subscription at any time through your account settings.
• Access After Cancellation: If you cancel your monthly subscription, you will continue to have access to the paid content until the end of your current billing cycle.
• Refund Policy: All one-time purchases are final and non-refundable. We do not provide prorated refunds for canceled monthly subscriptions.

5. Intellectual Property

All content, features, and functionality of the Service—including but not limited to the game design, interactive levels, software, text, graphics, logos, and UI—are the exclusive property of Euclidean Arts & Tech LLC or its licensors, and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of our Service without our express written consent.

Third-Party Assets: Certain assets, including specific sound effects and media, are used under license from their respective creators. Please review our Acknowledgements page for detailed attribution and licensing information regarding these third-party works.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Euclidean Arts & Tech LLC makes no warranties, whether express or implied, regarding the reliability, accuracy, or availability of the Service, including the performance of the browser MIDI API connection to your hardware.

7. Limitation of Liability

To the maximum extent permitted by law, Euclidean Arts & Tech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the Service. In no event shall our aggregate liability exceed the amount you paid us in the past twelve (12) months.

8. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court.

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.
• Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved by binding arbitration, rather than in court.
• Class Action Waiver: You and Euclidean Arts & Tech LLC agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

9. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or via email. By continuing to use the Service after those changes become effective, you agree to be bound by the revised Terms.
